Placing an Order By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these, then you should contact one of our customer service advisors at customercare@bellaray.com before placing an order with us. These Terms and Conditions and your use of our web site are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights. This website and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you. A Contract between the customer and Bellaray Limited for the sale of our products will only exist once an order has been accepted, processed and despatched ( at which point the buyers credit/debit card will be charged for the value of the goods despatched). This does not affect the customer's statutory rights. Prices and availability of goods is subject to change without notice. A delivery charge will be added to your order value, please see delivery times and charges. Returning an Item Our aim is make our customers as happy as possible. If you are in any way unsatisfied with your purchase, you may cancel your order with us as long as your items are returned in their original packaging, un-worn, un-used and in perfect condition, within 14 days of our receipt of your order. We will then happily exchange or refund the goods. Please send to: Returns Department, 11 Hazelbury Close, Merton Park, London SW19 3JL Please note for hygiene reasons earrings cannot be returned or exchanged. To make a return, please get in touch with us at customerservice@bellaray.com or call us on 0845 257 1880. The cardholder who bought the goods must have the card details ready for this call and if you email us, please do ensure you include a phone number we can call you on. A customer care assistant will give you a return authorisation number which you need to include with the name of the person who made the order, their telephone number and original order number. Please send to: We strongly recommend you obtain proof of posting when returning your items as we cannot accept responsibility for parcels lost in transit. We will only refund or provide an exchange for the costs of postage where the item is faulty. Exchanging an item If you would like to exchange an item please follow the instructions above for ‘Returning an Item’. Then re-order the item you wish to buy. We realise this means two transactions on your credit card, but it will be a faster way for you to get the product you would like. Your right to cancel You may normally cancel your order (once accepted by us) for any reason up to the point of despatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days. If you want to cancel your order, please contact us. It may not be possible to stop your order if it has already been sent, so in this instance, please follow the instructions in ”Returning an Item” above. Please take extra care to read our Product Care Information enclosed with your order as we cannot accept items for a refund or exchange if they have been damaged. Defective and damaged items If you should receive an item that is defective, damaged or not what you ordered, please contact us within 10 days. A personal shopping consultant will help you resolve any issues as quickly as possible by delivering another item, replacing your order or refunding the amount paid. Contract for sale Products advertised on this site are “invitation to treat”. Your order is an “offer”, not a contract for sale between you and Bellaray. These terms and conditions cannot be varied except by changes made by Bellaray on the site, which we may make from time to time. In particular, nothing said by any representative of Bellaray will operate as a variation to these terms and conditions or constitutes a legal representation on behalf of them. Receipt of order Bellaray must receive payment in full for your order before it can be accepted. Once your credit card has been authorized and stock is checked, Bellaray will send you an email receipt confirming your order. Please keep this receipt for your records. We can only accept orders for items that are in stock. In exceptional circumstances, if we are not able to fulfill an order we have accepted, your credit card will be re-credited with the original price, within 30 days of your transaction, and we will notify you by email. In no circumstances will we be liable to you for any additional amounts. Bellaray reserves the right to refuse to supply to any person for whatever reason. Payment & Security We accept online payment in a secure environment by credit and debit card. We currently accept Visa, MasterCard, Delta, Maestro, Switch and Solo. All transactions are shown in Pounds Sterling (£). Bellaray will not add any additional fees to your purchase if you pay via any of the card types supported by us. To securely receive your payments over the Internet, we use the very latest industry standard Secure Sockets Layer (SSL) encryption technology to allow for the encryption of potentially sensitive information and to ensure absolute safety. As a further precaution your credit card information is never retained. Please do not send orders via email, as we cannot guarantee any secure transmission of details. If you are still worried about security over the Internet, then please contact us by phone. Taxes All prices quoted on this website are accurate at the time of publication and are quoted in Pounds Sterling (£) and where appropriate are inclusive of UK sales tax (VAT) at the current rate. If your order is being despatched to a destination outside the European Community (EC) then your sales tax will be zero. If your order is being sent to a member state of the EC then the selling price will include VAT at the current rate. The current rate of VAT is 17.5%. Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them. Our Guarantee To You We endeavour to display through our website all items featured in our current range. However, occasionally an item will be out of stock and if this is the case, it will be highlighted on the product page and also in your Shopping Basket. All dates quoted for delivery are estimated delivery dates only and may be subject to change without prior notification to you. We can accept no liability for any loss or damage (whether direct or indirect) for delivery at any time other than the estimated date for delivery. All orders received after 1.00 pm will, subject to availability, be despatched on the following working day.
We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, while the colour reproduction of products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. All our products are handcrafted and there may be variations in colours of some materials, due to their natural properties, however we endeavour to provide as uniform products as possible. Your details and data Your privacy as an individual and as a customer is important to us, so we do not use the information you provide on this site to learn any more about you other than what is required to fulfil your orders or offer you services such as new alerts or reminder services. Bellaray does not combine your individual information with any kind of site analysis, but we do look at the overall browsing behaviour of our customers to improve the way the site navigates. We also do not track your behaviour on any other sites or follow you once you've left www.bellaray.com, but we do use cookies to help us provide a personalized service. Cookies A cookie is a small file stored on your computer by a web site to give you a unique ID. Cookies help make it easier and faster for you to use our site because it can remember if you've visited the site, and they help us provide you with the information you need about your gift reminders or account details - when and where you need it. Email usage Bellaray uses your email address as a convenient way to contact you about your order. From time to time, we may update you on relevant Bellaray site or new gift news, but only with your permission. We will not pass your details on to any other third parties. Customer responsibility Bellaray cannot guarantee that the sale and delivery of its goods to your particular country or location is permissible, so please be aware of your own geographic import restrictions. Liability Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. Notices Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at 11 Hazelbury Close, Merton Park, London SW19 3JL, UK and all notices from us to you will be displayed on our website from time to time. Events beyond our control We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident. Invalidity If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected. Privacy You acknowledge and agree to be bound by the terms of our privacy policy. Third party rights Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act Indemnity You agree fully to indemnify, defend and hold us, Bellaray, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your personal information. Copyright and other rights All materials, including logos, images, structures, designs of products, illustrations, designs layout, navigational flows, photographs, written and other text or script that are part of this site are protected by copyright, trade mark, trade dress and/or other intellectual property rights owned, controlled or licensed to Bellaray. The site as a whole is protected by copyright and trade dress, all worldwide rights, titles and interests in and to which are owned by Bellaray.
